Americans With Disabilities Act Policy

Barnstable County does not discriminate based upon disability and provides reasonable accommodations for qualified individuals with disabilities in a fair and equitable manner, and in accordance with applicable federal and state law. 

This policy applies to employees of Barnstable County, applicants for employment, volunteers and users of services in Barnstable County. 

Federal and State Regulations 

The Rehabilitation Act of 1973. Section 504 of the Rehabilitation Act makes it illegal for any entity receiving federal financial assistance to discriminate on the basis of disability. Section 504 obligates local governments to ensure that people with disabilities have equal access to any programs, services, or activities.  Covered entities, such as local governments, are also required to ensure that employment practices do not discriminate based upon disability.  The Americans with Disabilities Act (ADA) requires that state and local governments provide qualified individuals with disabilities equal access to their programs, services, or activities unless doing so would fundamentally alter the nature of their programs, services, or activities or would impose an undue burden.   Massachusetts General Law c 93 section 103 and Article CXIV of the Amendments to the Massachusetts Constitution prohibits discrimination, exclusion from participation, and denial of benefits on the basis of disability in any program or activity in the Commonwealth.

Grievance Procedure 

The following Grievance Procedure is established to meet the requirements of the Americans with Disabilities Act. It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in employment practices and policies or the provision of services, activities, programs, and benefits by Barnstable County.  The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaint such as personal interviews or a tape recording of the complaint, will be made available for persons with disabilities upon request.  The complaint should be submitted by the grievant and/or his/her designee as soon as possible, but no later than 60 calendar days after the alleged violation to:

Within 15 calendar days after receipt of the complaint, the Coordinator will meet with the complainant to discuss the complaint and possible resolutions. Within 15 calendar days after the meeting, the Coordinator will respond in writing, and, where appropriate, in a format accessible to the complainant, such as large print, Braille or audiotape. The response will explain the position of Barnstable County and offer options for substantive resolution of the complaint. If the response by the Coordinator does not satisfactorily resolve the issue, the complainant and/or his/her designee may appeal the decision of the ADA Coordinator within 15 calendar days after receipt of the response to the Barnstable County Commissioners or their designee.  

Within 15 calendar days after the receipt of the appeal, Barnstable County Commissioners or their designee will meet with the complainant to discuss the complaint and possible resolutions. Within 15 calendar days after the meeting the Barnstable County Commissioners or their designee will respond in writing, and where appropriate, in a format accessible to the complainant, such as audio tape, with a final resolution of the complaint.  

All complaints received by the Coordinator, appeals to the Barnstable County Commissioners or their designee, and responses from the ADA Coordinator and Barnstable County Commissioners or their designee will be kept by Barnstable County for at least three years.

Social Media Policy

To maintain regular community conversation, outreach and accessibility Barnstable County Children’s Cove holds a variety of social media platforms to raise awareness of itself as an organization and awareness of issues related to our services, and to provide timely updates or information concerning our services or location.  

We welcome you and your comments to social media accounts provided by Barnstable County Children’s Cove.

The purpose of our accounts are to present matters of public interest on Cape Cod, Nantucket and Martha’s Vineyard. We encourage you to submit your questions, comments, and concerns, but please note these are moderated online discussion sites and not a public forum. 

Once posted, Barnstable County Children’s Cove reserves the right to delete submissions that contain vulgar language, personal attacks of any kind, or offensive comments that target or disparage any ethnic, racial, or religious group. Further, Barnstable County Children’s Cove also reserves the right to delete comments that: (i) are spam or include links to other sites; (ii) are clearly off topic; (iii) advocate illegal activity; (iv) promote particular services, products, or political organizations; (v) infringe on copyrights or trademarks; (vi) use personally identifiable information; (vii) contain individual-specific and other confidential information. Please note that the comments expressed on our social media accounts do not reflect the opinions and position of Barnstable County’s Child Advocacy Center, Barnstable County Children’s Cove, or its officers and employees. Law

Please note, that Records Retention Law of the Commonwealth requires Barnstable County Children’s Cove to preserve records created or received by a state employee. Pursuant to this retention requirement comments posted, or messages received via an official Barnstable County Children’s Cove page on a third-party website (such as an official agency profile on a social network) will be treated as state governmental records and may be permanently archived. Information that you submit voluntarily through social media sites associated with Barnstable County Children’s Cove where such information is publicly available, including your name, city or town, and the substance of anything that you post may be disseminated further by being posted online at this website.
